Jury Nullification
Sentencing disparity and discrimination video based on gender depict that women are treated differently from men during sentencing. Women are treated less harshly to protect the interest of their children and keep their families together (Cassia, 2009).). However, women can be sentenced harshly due to the violation of gender rules by committing crimes which are an unwomanly thing to do. Men are treated harshly due to two different reasons. First, men commit more serious Crimes and secondly, due to their prior cases (Cassia, 2009). There are different types of sentence disparity. Biases on gender occur when both the female and male defendants have committed the same crime, but the woman is treated fairly. It is known as inter-jurisdictional disparity (Spohn, 2009). When offenders are convicted for the same crime but sentenced by different judges, they receive different sentences. It is known as intra-jurisdictional disparity (Cassia, 2009). Discrimination by judges occurs when the judge rules the case based on the character of the defendant rather that than characteristics of the situation.
