DNP 840 Discuss two bills or laws that influence nursing practice, one at the federal level and one at the state level

Nurse Practice Act (NPA) was primarily developed to protect the public and its patients (Young, 2019). It delineates what is considered safe practice which includes but not limited to the scope of nurse, delegation, and disciplinary process in each state. As practices differ from state to state, a nurse is held responsible to be knowledgeable in the similarities or differences that exist. The website of the National Council of State Boards of Nursing (NCSB) has a tool named “Find your Nurse Practice Act” to find specific state NPA. Also, nurse is to meet minimum requirements to practice safely when this is not meet her or she is considered a danger to the public and shall not continue with delivering services. This act influences practice within the organization as it sets a minimal set of standards of which professional nurses must meet to continue to be employed. When discussing specific influence that the NPA has on the future project is that it meets current NPA of Arizona. It is considered within scope of an advanced nurse practitioner or nurses to discuss advanced directives with patients.

At a federal level the Health Insurance Portability and Accountability Act (HIPAA) has an immense impact on nursing. This law sets the national standards to protect patients’ sensitive health information (Essefi, et al 2022). Individuals must consent and have knowledge of data that is being shared. When this is breached it is considered a civil and or criminal violation.  HIPPA influence the organization of the project as it they want to ensure they are protecting patient health information.  Upon presentation of the project the site will first make sure that the project is not placing their systems are risk. The site also has learner complete HIPPA training to understand responsibilities. Information gathered is protected by only having access via the organizations computers which are protected by password log and VPN. As consent is not a specific requirement for the project, the learner will put in place other measure to meet HIPPA. During the project the learner will not share patient information gathered and discard as per guidance. At the end of the project once data is collected and the learner is writing the outcomes, she will ensure to not include patient specific information.
